Supplier Terms and Conditions For Oro Associates Ltd (trading name Love Spain Holidays), with registered office in 58 Dukes Mead, Fleet, Hampshire GU51 4HE, United Kingdom, under number 6821461. Please read these booking conditions carefully as they are the sole terms and conditions of the contract between you and our suppliers, for all holiday components promoted by Love Spain Holidays. These terms and conditions apply equally to UK resident bookings as well as USA and other worldwide resident bookings. Love Spain Holidays does not represent or warrant that the information and terms and conditions available on this site are appropriate and/or available for use in other jurisdictions and access to the to the site’s information and terms and conditions from jurisdictions where its contents are unlawful is prohibited. You may only use this site for lawful purposes and in accordance with these terms and conditions. The person making the booking shall be deemed to have accepted the booking conditions on behalf of all the persons named in the booking. A binding contract exists between you and our suppliers when we send your invoice on the supplier’s behalf to the person making the booking; the terms and conditions of the relevant suppliers will then apply. Love Spain Holidays Responsibility i) Love Spain Holidays agree to act as the principle on each holiday component detailed in Schedule A and will handle all booking confirmations, amendments, cancellations and complaints with the suppliers of the offering. ii) Love Spain Holidays will make sure that the booking arrangements that have been agreed to make, perform or provide as applicable as part of our contract with the customer are made, performed or provided with reasonable skill and care. This means that, subject to these booking conditions, Love Spain Holidays will accept responsibility if, for example, the customer personal injury or the customers contracted booking arrangements are not provided as promised or prove deficient as a result of the failure of Love Spain Holidays, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, the customers contracted booking arrangements. Please note it is the customer’s responsibility to show that reasonable skill and care has not been used if the customer wishes to make a claim against Love Spain Holidays. In addition, Love Spain Holidays will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work Love Spain Holidays had asked them to do (for agents and suppliers). iii) Love Spain Holidays will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: - 1) the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of the customers booking and which were unforeseeable or unavoidable or 'force majeure' as defined below (iv) 2) Love Spain Holidays cannot accept responsibility for any services which do not form part of the customer’s contract. This includes, for example, any additional services or facilities, which the customers hotel or any other supplier agrees to provide for the customer where the services or facilities are not advertised in our package, written itinerary or website and Love Spain Holidays have not agreed to arrange them. 3) The promises Love Spain Holidays make about the services that have been agreed to be provided or arranged as part of our contract - and the laws and regulations of the country in which the customers claim or complaint occurred - will be used as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint complied with local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the UK which would have applied had those services been provided in the UK. The exception to this is where the claim or complaint concerns the absence of a safety feature, which might lead a reasonable client to refuse to take the break in question. 4) Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements (including the process of getting on and/or off the transport concerned) provided by any sea, rail or road carrier or any stay in a hotel, the maximum amount of compensation Love Spain Holidays will have to pay will be limited. The most that will be paid for that claim or that part of a claim if Love Spain Holidays are found liable to the customer on any basis is the most the carrier or hotel keeper concerned would have to pay under the international convention or regulation which applies to the travel arrangements or hotel stay in question. Please note: Where a carrier or hotel would not be obliged to make any payment to the customer under the applicable International Convention or Regulation in respect of a claim or part of a claim, Love Spain Holidays similarly are not obliged to make a payment to the customer for that claim or part of the claim. When making any payment, Love Spain Holidays are entitled to deduct any money which the customer has received or are entitled to receive from the transport provider or hotelier for the complaint or claim in question. 5) Please note, Love Spain Holidays cannot accept any liability for any damage, loss, expense or other sum(s) of any description (a) which on the basis of the information given to Love Spain Holidays by the customer concerning the customers booking prior to Love Spain Holidays accepting it, that Love Spain Holidays could not have foreseen the customer would suffer or incur if Love Spain Holidays breached their contract with the customer or (b) which did not result from any breach of contract or other fault by ourselves or our employees or, where Love Spain Holidays are responsible for them, our suppliers. Additionally Love Spain Holidays cannot accept liability for any business losses. 6) The customer must provide Love Spain Holidays and our insurers with all assistance that may be reasonably required. The customer must also tell Love Spain Holidays and the supplier concerned about the customers claim or complaint. If asked to do so, the customer must transfer to Love Spain Holidays or their insurers any rights the customer has against the supplier or whoever else is responsible for the customers claim or complaint (if the person concerned is under 18, their parent or guardian must do so). The customer must also agree to cooperate fully with Love Spain Holidays and their insurers if Love Spain Holidays or our insurers want to enforce any rights which are transferred. iii) Where Love Spain Holidays acts only as an agent under your contract in respect of the booking we make on your behalf with our various suppliers, for accommodation, transport or any other booked services, The Package Travel, Holidays and Tours Regulations 1992 does not apply for these terms and conditions for any booking you make and we do not act either as an ‘organiser’ or offer for sale ‘packages’ within the meaning of the Regulations. In this instance, the supplier’s booking conditions will apply to your contract and we accept no liability ourselves. iv) Love Spain Holidays does not accept any responsibility for any unreasonable distress, damage, crime or danger, caused by customers. v) Love Spain Holidays cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or the customer otherwise suffer any damage or loss as a result of "force majeure". In these Booking Conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control. Insurance Love Spain Holidays stresses the importance to the customer of taking adequate travel insurance to cover their holiday. Neither Love Spain Holidays nor our suppliers can be held responsible for any liability, expenses or losses the customer incurs as a result of being inadequately insured. We strongly recommend that at the time of booking a comprehensive travel insurance policy is purchased. Deposit Payment for Holiday Component Bookings Once a customer books a Love Spain Holidays holiday component, Love Spain Holidays will require a deposit payment as detailed in Schedule A. This deposit is non refundable to the customer, but the customer does reserve the right to cancel their holiday. Balance Payment for Holiday Component Bookings The full balance of the holiday component booking will be paid to Love Spain Holidays no later than 12 weeks prior to the customer’s departure date, except for those components already paid in full as set out in Schedule A. Special Requests Please check with Love Spain Holidays when you book if you wish to make a special request for any service or facility that is not automatically part of your booking. Love Spain Holidays will ask their suppliers and where possible they will try to help but please note such requests cannot be guaranteed. Late Booking Payments If a customer books less than 12 weeks prior to departure full payment will be forwarded immediately to Love Spain Holidays. Changes after booking but before travel Please note that it may not be possible to make any changes to a booking once confirmed unless the original booking is cancelled and a new booking made. Cancellation charges will apply as per the Cancellation Policy below. Prices applying to all new bookings made following a cancellation will be those prices applicable on the day the new booking is made. Love Spain Holidays reserves the right to cancel, change or substitute any service and to decline to accept or retain any tour members at any time for any reason including, without limitation, an insufficient number of participants. Please check the customers booking details carefully to ensure that any related flight and/or other arrangements coincide with the dates you have booked with us as Love Spain Holidays will not be liable for any costs incurred as a result of any mistakes by the customer. Cancellation Policy i) The customer may cancel the booking at any time providing that the cancellation is made in writing. The customer will be entitled to receive a refund of the amount paid less the cancellation fees specified below. ii) If for any reason a holiday component is changed by one of Love Spain Holidays suppliers, Love Spain Holidays cannot accept any liability for the changes to the booking, or responsibility for any expenses or costs the customer may incur as a result of any changes. Love Spain Holidays will do everything possible to arrange an alternative option for the customer. iii) For a significant change or cancellation to any customer booking Love Spain Holidays will advise the booking agent or customer as soon as possible. If there is time to do so before departure, Love Spain Holidays will offer the choice of the following options:- (a) (for significant changes) accepting the changed arrangements or (b) purchasing an alternative holiday component from Love Spain Holidays, of a similar standard to that originally booked if available. Love Spain Holidays will offer the customer at least one alternative option of equivalent or higher standard for which the customer will not be asked to pay any more than the price of the original holiday component. If this option is in fact cheaper than the original one, Love Spain Holidays will refund the price difference. (c) cancelling or accepting the cancellation in which case the customer will receive a full refund of all monies they have paid to Love Spain Holidays. | Period before Scheduled Departure Date that Notice of Cancellation is Received | Cancellation Charge as % of Booking Price | | 9 weeks or greater | Deposit | | 9 weeks or less | 100% | Passports/Visas and health requirements: It is the responsibility of all passengers, regardless of the passport they hold, to check with the appropriate consulates to determine if any visas are required. As visa and health requirements are subject to change without notice, it is recommended that verification prior to travel be made of existing foreign visa and health requirements. Love Spain Holidays will have no liability to the customer if they or any passenger with them travels without the correct passport or visa or health requirement and they will have to pay Love Spain Holidays any costs we incur through assisting you. Information Accuracy When Love Spain Holidays are told in advance of a significant change to a booking, we will make every effort to notify the customer before their travel. Please note that it is standard policy that hotel rooms and Villas are not available for check-in before 3.00 PM on the date of arrival. Please note all duration times for excursions given are approximate. Holiday Component Pricing Love Spain Holidays reserves the right to revise its pricing. No price increases will apply once full payment has been received for any booking. If You Have a Complaint If you have cause for complaint whilst on your trip, this must be brought to the attention of the relevant supplier immediately so that action can be taken to remedy the problem. Failure to report your complaint in this way may jeopardise any claim you subsequently make. Complaints must also be notified to the Love Spain Holidays Customer Services Department within 28 days after the end of the customers trip. The assistance we provide to resolve your complaint is provided on behalf of our suppliers in our capacity as agent only. Supplier’s Conditions You are bound by Love Spain Holidays suppliers own booking conditions and conditions of carriage where relevant and these conditions apply to your contract with us. In the event of any conflict between the supplier’s conditions and our own, our supplier’s conditions will prevail provided they are valid and enforceable, otherwise our conditions will prevail. Our supplier’s conditions may limit or exclude their and our liability to you and they may be subject to international conventions. Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned. Booking Notes for Villas: Customer Breakage/Security Deposits and Local Charges i) Love Spain Holidays will advise the customer of any local charges, including any customer breakage deposits required, so that the customer can be advised prior to booking the villa. ii) Any security deposits will be taken by local agents and not Love Spain Holidays or any selling agents. Villa Booking Process i) Love Spain Holidays will need to check the customers booking request for any villa to ensure full availability at time of booking. Love Spain Holidays will endeavour to respond within 24 hours if not sooner. ii) Love Spain Holidays availability as shown on their website is as accurate and up to date as their Supplier’s have provided and Love Spain Holidays cannot be held responsible for any disappointed customers if the villa requested is not available iii) Any booking made via the Love Spain Holidays website where card details have been provided by the customer, the customer’s card will not be processed until the booking has been confirmed as available and Love Spain Holidays has been in contact to advise and agree to transact on the customers account. Booking Notes for Excursions: Travel Voucher(s): Vouchers will be provided for each Love Spain Holidays booking. When presenting your pre-paid voucher(s) for redemption, the Lead Traveller is required to present valid photo identification, bearing the name of the Lead Traveller. The voucher may be confiscated if Photo ID, Credit Card / Gift Certificate and Signature do not match the Lead Traveller. Jurisdiction All disputes arising out of these booking conditions are subject to English and Spanish law as resolved in the English and Spanish courts alone. However, at our option, we may change the chosen country of law and jurisdiction, unless court proceedings have already been initiated. Schedule A: Love Spain Holidays Components of Supply | Holiday Component | Deposit % Required at time of Booking | | Golf Hotel and/or Green Fees | 25% | | Villas | 25% | | Excursions | Full Payment | | Specialist Packages | 25% | | Hotels | 25% | Important Golfing Extras Tee Times Love Spain Holidays will do everything possible to confirm the customers requested tee times, however hotels/golf courses do reserve the right to alter preferred tee times. If for any reason the customers tee times should not be available, as part of our service we will offer the customer the nearest possible alternative. Tee times are based on playing in four-balls and therefore the customer may be paired up with other golfers on the day. Resort courses are usually very busy in the high season and you should expect between a 4 and 4.5 hour round as a reasonable pace of play although this can be slower in extremely busy times. We cannot be held responsible for slow play on a golf course. Playing Conditions Although the standard of golf courses is inspected on a regular basis, their actual playing condition may vary from time to time. Course maintenance such as aerating greens, improving drainage will happen from time to time and often will be scheduled at such short notice, depending on weather, which means that we are not always made aware of when this will occur. Equally, in particularly dry spells, when there are water bans in place, fairways and greens may be burnt and not in the best of playing conditions. Events such as these are out of Love Spain Holidays’ control and we cannot be held responsible for the condition of the course during the customer’s holiday. Handicap Certificates Some hotels/golf courses will require handicap certificates before accepting visitors, which Love Spain Holidays will endeavour to advise of at the time of booking and by stating on the booking confirmation. Whilst a certificate of playing ability is not essential on all courses, the appropriate golfing etiquette and knowledge of golfing rules is expected and each hotel/golf course reserves the right to refuse access if it is judged that individuals do not display the required etiquette and/or knowledge. We cannot be held responsible in these circumstances. Dress Code Appropriate dress and footwear should be worn at all times on the course and in the clubhouse (as per the information included in each customer’s confirmation). Certain hotels require dress code for dinner and this will be advised at the time of booking and in the extra notes on the customers booking confirmation. Love Spain Holidays cannot accept any responsibility for any ruling by the hotel/golf course if the customer or any of the lead customers group is unable to play or dine due to inappropriate attire. Behaviour When the customer books with Love Spain Holidays, Love Spain Holidays do not accept responsibility for any damage or loss caused by the customer or any member of the lead customers party. Full payment for any such damage or loss must be paid direct at the time to the hotel. If the customer fails to do so, they will be responsible for meeting any claims subsequently made against Love Spain Holidays (together with our own and the other party’s full legal costs) as a result of the customers actions. Inclement Weather Policy As adverse weather is inevitable during the course of the year, hotels and golf courses may either close the golf course or operate temporary tees and greens at their sole discretion. In the event of this happening Love Spain Holidays Inclement Weather policy is as follows: Prior to arrival date If requested to do so Love Spain Holidays will call and check the status of the golf course on the customers behalf. Should the customer choose not to travel, subject to the policy of the supplier in these circumstances, Love Spain Holidays will try and postpone the customers golf holiday; however price supplements may be incurred depending on when the customer break is re-booked for. No refunds are available under any circumstance for cancellations made due to course closure. During the customers golf break: Golf played on temporary greens and tees is non-refundable and is considered to be an accepted part of playing winter golf. Please note that trolley and buggy bans occur frequently when a course is wet and are determined by those in charge of the golf course. If the customer is unable to play golf on their break due to course closure Love Spain Holidays will, without guarantee and at the supplier’s discretion, try and obtain a partial refund or green fee vouchers for the golf element of the break. It is however worth noting that Love Spain Holidays sell winter breaks at a discounted rate and so any refund will not be equivalent to the full green fee and with many of Love Spain Holidays winter breaks the golf element is considered complimentary. Each hotel and golf course sets its own inclement weather policy. All decisions regarding partial refunds or green fee vouchers are solely at the discretion of the hotel and golf course and are final. Love Spain Holidays cannot be held responsible should inclement weather prevail. Dress Code Appropriate Golf shoes to be worn on the golf course at all times – No trainers to be worn. Smart tailored trousers to be worn, no combat style jeans or denim to be worn. During the summer months shorts must be tailored; short white sport or knee length socks must be worn with tailored shorts. Shirts with collars will be permitted and must be tucked into waistbands - only recognised golf shirts to be worn. Shirts with large advertisement logos must not be worn. Headgear must be worn in the fashion it is designed for (i.e. peaks at the front). Etiquette - Arrive on the tee 10 minutes before "Tee-off" - Avoid Slow Play - Let other golfers through if you have slowed down or lost a ball - Avoid using a mobile phone on the course
